LABORATORY TECHNOLOGIES, INC. (the Seller) warrants that all new products of its manufacture (Products) shall be free from defects in material and workmanship under normal use and service. Any product found to be defective within five years of purchase shall be repaired or replaced by the Seller, free of all charges including transportation.

This Limited Warranty to repair applies only to new and unused Products, which after shipment from the factory of the Seller, have not been damaged, altered, changed, repaired or treated in any manner whatsoever by other than the Seller’s authorized representatives, and does not extend to trade accessories, though sold or operated with the Seller’s Products.

All Products replaced under this Limited Warranty will be warranted only for the duration of the original Limited Warranty period, and in no case beyond the expiration date of the Limited Warranty unless authorized in advance in writing by the Seller.

This Limited Warranty to repair is the Seller’s only warranty either express, implied, or statutory, upon which the Products are sold. Except as provided by this Limited Warranty, the Seller’s liability in connection with this transaction is expressly waived by the Purchaser.

The Seller shall have no responsibility or liability for loss of the Products, loss of time, inconvenience, commercial loss or consequential  damages.

No representative of the Seller has authority to change this Limited Warranty or the underlying contract in any manner  whatsoever and no attempt to repair or promise to repair or improve the Products covered by this Limited Warranty or the underlying contract by any representative of the Seller shall waive any consideration of the underlying contract or change or extend this Limited Warranty in any manner whatsoever

This warranty does not apply: (a) to consumable parts, such as batteries, unless damage has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic; (c) to damage caused by use with non-Laboratory Technologies, Inc. products; (d) to damage caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; (e) to damage caused by operating the product outside the permitted or intended uses described the Seller; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Laboratory Technologies, Inc. or a Laboratory Technologies, Inc.  Authorized Distributor; (g) to a product or part that has been modified to alter functionality or capability without the written permission of the Seller; or (h) if any Laboratory Technologies, Inc. serial number has been removed or defaced.

The Seller does not warrant that the operation of the product will be uninterrupted or error-free. The Seller is not responsible for damage arising from failure to follow instructions relating to the product’s use.

THERE IS NO OTHER EXPRESS WARRANTY ON GOODS COVERED BY THIS AGREEMENT.

ANY IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS IS LIMITED TO THE FIVE YEAR DURATION OF THIS LIMITED WARRANTY.

The Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
